These are the terms on which CVmotive offers the website and the application at cvmotive.com. By creating an account or using CVmotive you agree to them. If you do not agree, do not use CVmotive.

How we handle your personal data is described separately, in the privacy policy.

Article 1. What CVmotive is

1. CVmotive is an online service for writing CVs and cover letters, tailoring them to job postings, checking them and exporting them as PDF documents.
2. Part of CVmotive is free. The rest is Pro, which you buy as a pass for a fixed number of days or as a subscription. What each plan includes, and what it costs, is set out on the pricing page.
3. CVmotive is offered to consumers and to individuals acting in a professional capacity. It is not offered to anyone under 18.

Article 2. Your account

1. You sign in with your email address and a code we send to it. You must use an email address you control, and you must keep that mailbox secure: anyone who can read it can sign in as you.
2. You are responsible for everything done through your account. Tell us at once if you believe someone else has used it.
3. You may create one account for yourself. You may not share an account, or create accounts for other people.

Article 3. Rules of use

1. You may use CVmotive only for its purpose: preparing your own applications. In particular, you may not:
   • use it in a way that breaks the law or infringes anyone's rights;
   • upload material that is unlawful, defamatory or that you have no right to use;
   • attempt to gain access to accounts, documents or systems that are not yours;
   • copy, scrape or extract the templates, the software or other users' content;
   • circumvent the limits of the free plan or of a Pro package, or share Pro with people who have not bought it;
   • use CVmotive to send spam or to bulk-produce documents by automated means;
   • interfere with the operation of the service or place an unreasonable load on it.
2. If you break these rules we may suspend or close your account, without notice where the breach is serious. We may also remove content that violates them.

Article 4. Your content, our content

1. Your documents are yours. You keep every right in the CVs, cover letters and other content you put into CVmotive, and in the PDF files you export.
2. You give us the right to store, process and display your content as far as is needed to provide CVmotive to you. That right ends when the content is deleted. We do not use your content for anything else, and we do not use it to train automated systems.
3. You are responsible for what your documents say. You confirm that you have the right to use what you upload and that it does not infringe anyone else's rights.
4. CVmotive itself — the software, the templates, the designs, the texts on the site and the CVmotive name and logo — belongs to us or to our licensors. You may not copy it, sell it or use it outside CVmotive.

Article 5. Automatic suggestions

1. CVmotive offers automatic suggestions: help writing a bullet point, a version of a CV tailored to a job posting, a check that scores a CV and lists things to fix, and similar features. They are produced by automated systems from the text you give them.
2. Automatic suggestions are aids, not advice. They may be incomplete, out of place or wrong, and a score is an estimate, not a verdict. You decide what goes into your documents, and you are responsible for their accuracy and truthfulness, including anything you accepted from a suggestion.
3. We make no promise that using CVmotive, or following its suggestions, will lead to an interview, a job or any other outcome.

Article 6. Prices and payment

1. Prices are shown on the pricing page and at checkout, in the currency shown there. Taxes are shown at checkout before you pay.
2. Payment is taken by our payment provider using the methods offered at checkout. Pro starts as soon as the payment succeeds.
3. A pass is one payment for a fixed number of days of Pro. It ends on the day stated and does not renew. If you buy a pass while already on Pro, its days are added to the end of what you have.
4. A subscription renews at the end of each period — monthly or yearly, as chosen — at the price shown when you bought it, until you cancel. If a renewal payment fails, we will tell you and try again; if it still fails, the subscription ends and your account returns to the free plan.
5. We may change our prices. A price change never affects a pass you have already bought or the current period of a subscription; for a subscription it applies from the next renewal, and we will tell you at least 30 days beforehand so that you can cancel first.

Article 7. Right of withdrawal

1. If you are a consumer in the European Economic Area, you have a statutory right to withdraw from a distance purchase within 14 days without giving a reason. How that right applies depends on what you bought.
2. Passes. A pass is a digital service that starts immediately. By buying one you ask us to start it at once and acknowledge that, once Pro is active on your account, the right of withdrawal lapses.
3. Subscriptions. You may withdraw from a subscription within 14 days of your first payment by telling us at support@cvmotive.com. We will refund that payment, less an amount in proportion to the days of Pro you had before you withdrew. The right of withdrawal applies to the first payment only, not to renewals; renewals are governed by Article 8.

Article 8. Duration and cancellation

1. A subscription runs until you cancel it. You can cancel at any time from your account. Your account stays Pro until the end of the period you have paid for and is not renewed after that.
2. Apart from the right of withdrawal in Article 7, amounts already paid are not refunded, in whole or in part, when you cancel or stop using CVmotive.
3. You may close your account at any time by emailing support@cvmotive.com. Closing the account deletes your documents; download anything you want to keep first.
4. We may close your account if you break these terms (Article 3), or if it has been inactive for two and a half years. We may also stop offering CVmotive altogether; if we do, we will give you at least 30 days' notice and refund the unused part of any pass or subscription period.

Article 9. Availability and maintenance

1. We aim to keep CVmotive available at all times but do not guarantee it. It may be unavailable for maintenance, because of a fault, or for reasons outside our control. Where maintenance is planned, we will try to schedule it outside busy hours and to announce it beforehand.
2. We may change CVmotive — add, alter or remove features — as it develops. A change that materially reduces what a Pro package includes during a period you have paid for entitles you to a refund of the unused part of that period.
3. Your documents can be exported as PDF at any time. Keep your own copies of anything important.

Article 10. Liability

1. Our liability to you for any breach of these terms or of the law is limited to the amount you paid us in the three months before the event that gave rise to the claim.
2. We are not liable for indirect or consequential loss, including lost income, lost opportunities or an application that was not successful, or for loss caused by a failure that is not attributable to us, such as an outage of a network, a supplier or a device.
3. Nothing in these terms limits our liability where the law does not allow it to be limited, including for death or personal injury caused by negligence, or for loss caused by our intent or gross negligence.
4. We are not liable for any failure to perform caused by circumstances beyond our reasonable control.

Article 11. Changes to these terms

1. We may change these terms. If a change is material, we will tell you by email or in the application at least 30 days before it takes effect.
2. If you continue to use CVmotive after a change takes effect, you accept the changed terms. If you do not accept them, you may cancel any subscription and close your account before that date; if the change adversely affects a period you have already paid for, we will refund the unused part.

Article 12. Other provisions

1. These terms are governed by the law of the Netherlands. Disputes are brought before the competent court in the Netherlands. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of the country where you live, or of the right to bring a claim in that country.
2. If any provision of these terms is found to be invalid, the rest remains in force, and the invalid provision is replaced by a valid one that comes as close as possible to its purpose.
3. These terms and the privacy policy are the whole agreement between you and CVmotive about its use.
